Tax Agent Services Act 2009 – Disclosure Statement

Blackwood Bookkeeping Solutions Pty Ltd is a registered BAS Agent, as required in order to provide BAS services, including advice, interpretation, interaction with the Australian Taxation Office (ATO), and lodgement of approved forms in respect to GST, BAS obligations, payroll reporting, and superannuation guarantee matters.

Any practitioner providing these services must be a registered BAS Agent or Tax Agent.

Regulatory Oversight and Professional Obligations

We are subject to the Code of Conduct prescribed under the Tax Agent Services Act 2009 (TASA) and related legislative instruments.

The Tax Practitioners Board (TPB) regulates registered BAS Agents and Tax Agents. We are also required to comply with ATO requirements in our use of Online Services and relevant lodgement software.

Practitioner Disclosure

To the best of our knowledge, and based on all information known to us, Blackwood Bookkeeping Solutions Pty Ltd and its representatives:

  • Have not committed a prior material breach of the Tax Agent Services Act 2009 or instruments made under the Act
  • Are not currently being investigated by the TPB for any material breach
  • Are not subject to any sanctions imposed by the TPB
  • Do not have any conditions applying to our registration
  • Have not been disqualified from providing BAS services
  • Do not employ or engage any persons who have been disqualified from providing BAS services
  • Maintain appropriate systems of supervision, quality control, and governance over work performed on our behalf
  • Have not been charged with or convicted of an offence involving fraud or dishonesty
  • Have not been subject to a promoter penalty under taxation law
  • Have not been charged with or convicted of a serious taxation offence

We are not aware of any matter that we have not otherwise disclosed that would significantly influence your decision to engage or continue to engage our services.

Complaints

We encourage clients to raise any concerns with us first so we may respond and resolve issues promptly.

Complaints about BAS Agent services may also be made directly to the Tax Practitioners Board (TPB).

Our Rights, Responsibilities, and Obligations

As a registered tax practitioner, our obligations under taxation laws (including TASA and the Code of Conduct) include, but are not limited to:

  • Acting lawfully in the Client’s best interests
  • Acting honestly and with integrity
  • Managing conflicts of interest appropriately
  • Taking reasonable care to ensure taxation laws are complied with
  • Providing services competently and in a timely manner

Your Obligations as a Client

Your obligations to Blackwood Bookkeeping Solutions Pty Ltd include:

  • Providing complete and accurate information in a timely manner
  • Being truthful in all information supplied to us
  • Advising us of changes relevant to the BAS services being provided
  • Maintaining appropriate business records
  • Cooperating with requests and meeting compliance due dates

Statements Made to the ATO

Under the law, we must not make, prepare, or permit the making of a statement to the Commissioner of Taxation that:

  • Is false, incorrect, or misleading in a material particular, or
  • Omits information that causes the statement to be misleading

If we become aware that a statement previously made is false or misleading, we are required to discuss this with you and advise that the statement should be corrected, including outlining the possible consequences of not doing so.

Legislative Requirement

This Disclosure Statement is provided in accordance with Section 45(2) of the Tax Agent Services Act 2009 and must be made available when an entity is considering engaging or re-engaging a registered BAS Agent, or upon request.

This information is true and correct at the time of publication. Any material change will be updated within 30 days of us becoming aware of the change.
